By accessing, browsing, or using the RideKartel website (www.ridekartel.com) and services, you acknowledge that you have read, understood, and agreed to comply with these terms. If you do not agree with any part of these terms, you must not use the Website or services.
RideKartel provides an online car booking platform that connects vendors (vehicle owners) with customers who wish to rent high-end vehicles. The platform’s primary objective is to help car rental service providers, particularly those marketing on social media, reach a broader audience. By using RideKartel, whether or not you register an account, you are legally bound to comply with these Terms and Conditions.
Eligibility, Registration, and Verification
To use RideKartel, you must be at least 21 years old and capable of entering into legally binding contracts under applicable law. Vendors must ensure their vehicles are legally registered and insured before listing them on the platform. RideKartel reserves the right—but not the obligation—to perform background checks, screenings, and verification processes to ensure the legitimacy of vendors and their vehicles. However, RideKartel is not liable for any misrepresentation by vendors.
By signing up and making a booking on RideKartel, you confirm that you are at least 21 years old and hold a valid UK driving license. Vendors have the right to request proof of your driving license at the time of vehicle collection or delivery.
To complete a booking, customers must provide the vendor with all necessary details as requested. This may include, but is not limited to:
- Valid identification (passport or driver’s license)
- Proof of address
- Payment details for security purposes
- Any additional information required by the vendor
Failure to provide accurate and complete information may result in cancellation of the booking without a refund.
It is the customer’s responsibility to ensure they meet all eligibility criteria before making a booking.
Vendor Responsibilities and Liability
Insurance Requirement
Vendors are solely responsible for ensuring that their vehicles have valid and appropriate insurance coverage that complies with all legal and regulatory requirements. RideKartel does not provide insurance and is not liable for any issues arising from a vendor’s failure to obtain adequate insurance.
Account Security and Responsibility
Vendors are responsible for all activity conducted under their RideKartel account. If any suspicious activity, unauthorized access, or security breaches occur, vendors must immediately notify RideKartel. RideKartel is not responsible for a vendor’s failure to report unauthorized use of their account or for any delay in suspending or securing their account due to a vendor’s negligence.
Fees and Payment Structure
RideKartel charges fees at checkout for using its services. Vendors must link a valid bank account to receive payments. Customers provide payment details at checkout, and RideKartel deducts its commission before transferring the remaining balance to the vendor. Vendors agree that RideKartel may securely store their payment details for seamless transactions. Any disputes regarding payments must be reported within seven days of the transaction date.
Extra Mileage Charges: By booking a vehicle through our platform, you acknowledge and agree that the rental price may or may not include a specified mileage limit, depending on the vendor’s terms. If a mileage limit is provided and you exceed this limit, you will be charged an additional fee for the extra miles driven, as outlined in the rental agreement. If no mileage limit is specified, you will not incur extra mileage charges. The cost per extra mile is determined entirely by the vendor and will be calculated at the end of your rental period. To cover potential charges, we may place a pre-authorization hold on your payment method at the time of booking. If extra mileage is incurred, we will charge the payment method on file for the total amount due, including any additional mileage fees. By completing your booking, you consent to this charge and authorize us to process payment for any excess mileage. This charge will be transferred to the car rental vendor, less our platform commission.
Deposit Fees: Some vendors may require a deposit fee at the time of booking, which will be refunded to you at the end of the rental period, provided the vehicle is returned in the same condition as it was rented and there are no additional charges (such as for damages, late returns, or extra mileage). The deposit is a precautionary measure to protect the vendor against any unforeseen costs or liabilities that may arise during the rental period. By completing your booking, you acknowledge and agree that the deposit will be placed on hold or charged to your payment method at the time of booking. Refunds will be processed after the rental has concluded and any necessary deductions have been made. The amount of the deposit is determined entirely by the vendor and may vary depending on the vehicle or rental terms.
By booking a vehicle through RideKartel, customers agree to abide by all rules and regulations set by the vendor. Failure to comply with these rules may result in penalties, including but not limited to loss of deposit and early termination of the rental agreement.
If a vendor issues warnings regarding excessive speeding or any other violations and the customer continues to disregard these warnings, the vendor has the full right to retain the deposit (which is non-refundable) and collect the vehicle immediately without further notice.
Customers also agree to pay any excess fees if damages occur to the vehicle that exceed the initial deposit amount. The vendor reserves the right to assess damages and charge the necessary fees to cover repairs.
Cancellation Policy
If a customer decides to cancel their booking, the cancellation fee is determined entirely by the vendor. Each vendor may have their own cancellation policy, which will be displayed at the time of booking.
- If a refund is applicable based on the vendor’s policy, it will be processed back to the original payment method.
- RideKartel retains its 9% platform fee on the booking amount, even in the case of cancellations.
- Any applicable processing fees (e.g. transaction fees) may be deducted from the refund amount.
- Deposits will only be refunded if the vendor’s policy allows for it.
Customers are advised to carefully review the vendor’s cancellation terms before completing their booking.
Tax Responsibility
RideKartel is not responsible for calculating, collecting, or remitting any taxes on behalf of vendors. Vendors are solely responsible for determining their tax obligations, including income tax, VAT, and any other applicable levies. Vendors must comply with all tax laws and regulations in their respective jurisdictions.
Prohibited Activities
Users of RideKartel, including vendors and customers, must not:
- Violate any UK law, regulation, court order, airport regulation, tax regulation, licensing requirement, or third-party rights.
- Post false, misleading, or defamatory listings.
- Use RideKartel’s services to harm the platform’s reputation or brand.
- Register and/or use “RideKartel” or similar terms in domain names, trade names, trademarks, or social media accounts in a misleading manner.
- Provide false or misleading information, including but not limited to:
- Fake names, dates of birth, driver’s license details, payment methods, or insurance information.
- False claims related to vehicle damage.
- Registering a RideKartel account on behalf of another person or company without permission.
- Impersonating another individual or entity.
- Fail to fulfill commitments, including:
- Not paying fees, penalties, or amounts owed.
- As a vendor, failing to make vehicles available as agreed.
- Completing transactions outside the RideKartel platform to avoid service fees.
- Transferring RideKartel accounts to another party without consent.
- Leaving a vehicle unlocked or running with keys inside (except where instructed by RideKartel in special cases).
Vendor Commitments
Vendors agree to:
- Provide vehicles that are legally registered, insured, and roadworthy.
- Ensure vehicles have valid license plates and are in good mechanical condition.
- Deliver vehicles only to approved customers listed on RideKartel.
- Not collect personal information from customers beyond verifying their driver’s license.
- Not use customer data to conduct background checks or collect additional personal data.
- Maintain accurate listings and honor all representations made in those listings.
- Not require customers to accept unwanted vehicle swaps or price increases.
- Not offer vehicles they do not own or do not have the legal right to rent.
- Not list vehicles that have been reported as missing or stolen.
- Not offer vehicles that are subject to safety recalls without first resolving the recall issue.
- Remove any weapons or firearms from vehicles before rental.
Termination and Suspension
RideKartel reserves the right to suspend or terminate any account that violates these Terms and Conditions without prior notice. Violations may result in removal from the platform, loss of payments, and potential legal action.
Limitation of Liability
RideKartel is not responsible for:
- Any damages, losses, or disputes arising from transactions between vendors and customers.
- Any liability related to the condition, legality, or insurance status of vendor vehicles.
- Any security breaches due to vendors failing to protect their accounts.
Amendments
RideKartel may update these Terms and Conditions periodically. Continued use of the platform after updates constitutes agreement to the revised terms.
